USING PROCEDURE
Under California Penal Code section 1382(a)(3), the Court has 45 days from the date of your arraignment in which to give you a trial.
- If you have not requested an extension, and
- if you have not waived your right to a speedy trial, and
- if the Court does not try you within 45 days of your first appearance on the case,
- then the court "shall order the action to be dismissed."
While it is difficult to cause this situation on purpose, it does occur on occasion, and it is a very easy win.
