Defendant was cited for violation of Vehicle Code section 22350, the Basic Speed Law.
Before and at trial the defendant raised numerous issues but failed to get a single positive ruling from Judge Pro Tem Nash. These issues included, among others:
- the fact that the case involved an illegal speed trap;
- the fact that the DA failed to comply with the discovery request;
- the fact that the officer failed to present sufficient evidence to justify a conviction;
- the fact that Judge Pro Tem Nash denied him due process by not letting him complete his cross-examination of the officer.
The appellant's Opening Brief contained 11 points including (the obligatory) "Ignorance of the Law."
The Appellate Division reversed the decision by agreeing that the case involved an illegal speed trap, and thereby avoided "the necessity of reaching the other issues raised in this appeal."
